MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 28, 2002
Chairperson Thompson called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:01 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Harney, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.
Motion by Lehman, second by Neuzil, to approve the minutes of the formal meeting of February 21 and 22, 2002 and the formal meeting of February 25, 2002.
Motion by Harney, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
RESOLUTION 02-28-02-B1
RESOLUTION RELATING TO FINANCING OF CERTAIN PROPOSED PROJECTS TO BE UNDERTAKEN BY JOHNSON COUNTY, IOWA; ESTABLISHING COMPLIANCE WITH REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE
Be It Resolved by the Board of Supervisors (the "Board") of Johnson County, Iowa (the "County"), as follows:
Section 1. Recitals.
(a) The Internal Revenue Service has issued Section 1.150-2 of the Income Tax Regulations (the "Regulations") dealing with the issuance of bonds, all or a portion of the proceeds of which are to be used to reimburse the County for project expenditures made by the County prior to the date of issuance.
(b) The Regulations generally require that the County make a prior declaration of its official intent to reimburse itself for such prior expenditures out of the proceeds of a subsequently issued borrowing and that the borrowing occur and the reimbursement allocation be made from the proceeds of such borrowing within a certain period after the payment of the expenditure or the date the projects are placed in service; and
(c) The County desires to comply with requirements of the Regulations with respect to certain projects hereinafter identified.
Section 2. Official Intent Declaration.
(a) The County proposes to undertake the projects shown on Exhibit A and to make original expenditures with respect thereto prior to the issuance of bonds, notes or other obligations (the "Bonds") and reasonably expects to issue the Bonds for such projects in the total maximum principal amount shown on Exhibit A.
(b) Other than (i) expenditures to be paid or reimbursed from sources other than the Bonds or (ii) expenditures made not earlier than sixty days prior to the date of this Resolution or (iii) expenditures amounting to the lesser of $100,000 or 5% of the proceeds of the Bonds or (iv) expenditures constituting preliminary expenditures as defined in Section 1.150-2(f)(2) of the Regulations, no expenditures for the projects have heretofore been made by the County and no expenditures will be made by the County until after the date of this resolution.
(c) This declaration is a declaration of official intent adopted pursuant to Section 1.150-2 of the Regulations.
Section 3. Budgetary Matters.
As of the date hereof, there are no County funds reserved, allocated on a long term basis or otherwise set aside (or reasonably expected to be reserved, allocated on a long term basis or otherwise set aside) to provide permanent financing for the expenditures related to the projects, other than pursuant to the issuance of the Bonds. This resolution, therefore, is determined to be consistent with the County’s budgetary and financial circumstances as they exist or are reasonably foreseeable on the date hereof, all within the meaning and content of the Regulations.
Section 4. Reimbursement Allocations.
The County Auditor shall be responsible for making the "reimbursement allocations" described in the Regulations, being generally the transfer of the appropriate amount of proceeds of the Bonds to reimburse the source of temporary financing used by the County to make payment of the prior costs of the projects. Each allocation shall be evidenced by an entry on the official books and records of the County maintained for the Bonds, shall specifically identify the actual prior expenditure being reimbursed or, in the case of reimbursement of a fund or account, the fund or account from which the expenditure was paid, and shall be effective to relieve the proceeds of the Bonds from any restriction under the bond resolution or other relevant legal documents for the Bonds, and under any applicable state statute, which would apply to the unspent proceeds of the Bonds.
Section 5. Repealer.
All resolutions, parts of resolutions, or actions of the Board in conflict herewith are hereby repealed, to the extent of such conflict.

Motion by Stutsman, second by Lehman, to set 6 public hearings on the notes for March 11, 2002 at 5:00 p.m.
Motion by Lehman, second by Stutsman, to form a committee with County Treasurer Tom Kriz, Budget Coordinator Jeff Horne, County Auditor Tom Slockett, Tony Roetlin and staff, as needed, to obtain bid quotations for selling notes from the list of Johnson County’s local depositories.

TO FIX A DATE FOR PUBLIC HEARINGS ON LOAN AGREEMENTS
Whereas, the Board of Supervisors of Johnson County (the "County"), proposes to enter into loan agreements (the "Loan Agreements") in the total principal amount of $8,415,000, pursuant to the provisions of Sections 331.402 and 331.443 of the Code of Iowa, for the essential county purposes of paying the cost, to that extent, of remodeling, reconstructing and equipping the Johnson County Jail, in an amount not to exceed $800,000; remodeling, reconstructing and equipping the Johnson County Administration Building, in an amount not to exceed $800,000; remodeling, reconstructing and equipping the Johnson County Ambulance Building, in an amount not to exceed $310,000; remodeling, reconstructing and equipping the Johnson County Courthouse, in an amount not to exceed $235,000; remodeling, reconstructing and equipping the Johnson County Secondary Roads Building, the Johnson County Health Department Building, the Johnson County Department of Veterans’ Affairs, the Johnson County Conservation Department Operations Center, the Johnson County Department of Human Services Building and the Johnson County SEATS Building, in an amount not to exceed $120,000; and funding health and liability self-insurance programs and acquiring, developing and improving a geographic computer data base system suitable for automated mapping and facilities management, in an amount not to exceed $6,150,000; and
Whereas, it is necessary to fix a date of meeting of this Board at which it is proposed to take action to enter into the Loan Agreements and to give notice thereof as required by such law;
Now, Therefore, It Is Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:
Section 1. This Board shall meet on the 11th day of March, 2002, at the Board Room, Johnson County Administration Building, Iowa City, Iowa, at 5 o’clock p.m., at which time and place hearings will be held and proceedings will be instituted and action taken to enter into Loan Agreements.
Section 2. The County Auditor is hereby directed to give notice of the proposed action on the Loan Agreements setting forth the amounts and purposes thereof, the time when and place where the said meeting will be held, by publication at least once and not less than four nor more than twenty days before the meeting, in a legal newspaper of general circulation in the County.
The notices shall be in substantially the following forms:

The Loan Agreement is proposed to be entered into pursuant to authority contained in Section 331.402 of the Code of Iowa. The Loan Agreement will constitute a general obligation of the County.

The Board of Supervisors of Johnson County, Iowa, will meet on the 11th day of March, 2002, at the Board Room, Johnson County Administration Building, Iowa City, Iowa, at 5 o’clock p.m., for the purpose of instituting proceedings and taking action to enter into a loan agreement (the "Loan Agreement") and borrow money in the principal amount of not to exceed $120,000 for the purpose of paying the cost, to that extent, of remodeling, reconstructing and equipping the Johnson County Secondary Roads Building, the Johnson County Health Department Building, the Johnson County Department of Veterans’ Affairs, the Johnson County Conservation Department Operations Center, the Johnson County Department of Human Services Building and the Johnson County SEATS Building.

Be It Resolved by the Johnson County Board of Supervisors in session held on February 28, 2002, as follows:
That a public hearing be set for the following application requesting approval of a Conditional Use Permit for a Home Business:
1. Application CU02002 of Jerry and Judy Lorimor requesting a Conditional Use Permit to operate a small retail sales business as a home business on property described as being located in the NE 1/4 of Section 26, Township 79 North, Range 7 West of the 5th P.M. in Johnson County, Iowa. This parcel is located on the north (west) side of Hwy. #1 SW, approximately 1/2 mile west of it’s intersection with Landon Ave. SW. (3194 Hwy #1 SW, Iowa City, IA., 52240) (Union Twp.)

CHANGING DEPARTMENTAL APPROPRIATIONS
Whereas, the appropriations for Township Trustees, Department 18, Service Area 8, are not sufficient to meet increasing demands for services, and planned fourth quarter appropriations are deemed necessary to meet third quarter requirements;
Be it resolved that the appropriation for the General Basic Fund, Department 18, be increased $797, for a total appropriation of $3,185 appropriated through June 30, 2002 the end of the fourth quarter;
Motion by Stutsman, second by Lehman, to approve Resolution 02-28-02-B3.
Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Linn-Johnson County Line Agreement defining and clarifying the division of responsibility, action and cost in the construction and/or maintenance of highway facilities along the boundary between Linn County and Johnson County.

Therefore, Be It Resolved by Johnson County that all of the above described road and right-of-way, together with any and all rights of Johnson County in and to the same are hereby closed, vacated and abandoned, and Johnson County hereby disclaims any right, title or interest in and to said part of present right-of-way to the use thereof, for any purpose whatsoever.

VACATION OF A ROAD IN JOHNSON COUNTY
Whereas, a public hearing was held on Thursday, November 1, 2001, at 9:30 a.m. in the Board Room of the Johnson County Board of Supervisors on the proposed vacation and closure of a Johnson County road, described as follows:
(Road Vacation 02-2001): Beginning at the Southeast Corner of the Southeast Quarter of the Southwest Quarter of Section 8, Township 80 North, Range 6 West of the 5th P.M.; thence North 4 rods; thence West 80 rods; thence South 4 rods; thence East 80 rods to the place of beginning, containing 2 acres.
Whereas, no objections were received on Road Vacation 02-2001; and
Whereas, said part of present right-of-way is no longer required for use by the public for highway purposes and will not hereafter be required for construction or maintenance purposes for any highway;
Therefore, Be It Resolved by Johnson County that all of the above described road and right-of-way, together with any and all rights of Johnson County in and to the same are hereby closed, vacated and abandoned, and Johnson County hereby disclaims any right, title or interest in and to said part of present right-of-way to the use thereof, for any purpose whatsoever.

RESOLUTION 02-28-02-03
AUTHORIZING WEIGHT EMBARGOES ON SECONDARY ROADS
Whereas, the recent weather conditions have caused soft subgrade and surface conditions to develop on some Secondary Roads; and
Whereas, it is deemed to be in the best public interest and welfare to preserve the road system in the best possible condition; and
Whereas, Sections 321.471, 321.472, and 321.473 of the Code of Iowa provide local authorities the right to restrict the weight of vehicles;
Therefore, be it resolved that an embargo be authorized where necessary on the Secondary Roads System for Johnson County. The County Engineer is authorized beginning on February 28, 2002 to restrict gross loads on certain sections of the road system showing extreme distress at this time. He shall be authorized to restrict all traffic to an 8-ton gross load if necessary and to place temporary signs to comply with Section 321.472.

Whereas, County of Johnson Iowa (subgrantee), has made application through Iowa Emergency Management Division (EMD) to the Federal Emergency Management Agency (FEMA) for the Hazard Mitigation and Risk Assessment GIS Database Grant Program, in the amount of $ 10,000 for the total project, or $5,000 as the 50% federal share, and
Whereas, Johnson County (subgrantee) recognizes the fact that the Hazard Mitigation and Risk Assessment GIS Database Grant Program is a 50% federal / 50% local matching grant, and
Whereas, Johnson County (subgrantee) shall form an agreement with Iowa EMD and FEMA as to the date that said 50% shall be available to match the federal funds awarded.
Johnson County (subgrantee) agrees to provide $5,000 (Five Thousand dollars) of local monies to be used as matching funds for the Hazard Mitigation and Risk Assessment GIS Database Grant Program as outlined in the grant application.

REPRESENTATIVE RESOLUTION FOR A HAZARD MITIGATION AND RISK
ASSESSMENT GIS DATABASE GRANT PROGRAM
Be It Resolved by Johnson County, Iowa that Rick Havel, Johnson County GIS Coordinator ,is hereby authorized to execute on behalf of Johnson County Emergency Management , this hazard mitigation project and to file it with Iowa Emergency Management Division (IEMD) for the purpose of obtaining Federal/State financial assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (PL 93-288, as amended) and the Code of Iowa, Chapter 29C.
Motion by Stutsman, second by Neuzil, to approve Resolution 02-28-02-04 and Resolution 02-28-02-05.
Motion by Stutsman, second by Neuzil, to appoint Tom Brase as the Interim SEATS Director effective March 3, 2002 at an annual salary of $47,000.
Motion by Lehman, second by Harney, to approve the revisions to the Paratransit Advisory Committee By-laws.
Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign the letter of support for United Action for Youth's Grant Application to continue the Runaway and Homeless Youth Program.
Motion by Lehman, second by Neuzil, to approve and authorize the Chairperson to sign the letter of support for United Action for Youth's Application to provide funding for Transitional Independent Living Program.
Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to send Richard Fishel a letter of appreciation and certificate for serving on the Johnson County Historic Preservation Commission.
Motion by Lehman, second by Stutsman, to appoint Ambulance Director Steve Spenler to the Johnson County Ambulance Advisory Committee for an indefinite term.
Motion by Lehman, second by Stutsman, to approve and authorize the Chairperson to sign the following Applications For Fireworks Permit: Gene Zdrazil, 6090 River Junction Road SE, Lone Tree, on March 23, 2002 with a rain date of March 24, 2002; and Gene Zdrazil, 6090 River Junction Road SE, Lone Tree, on April 27, 2002. Roll call: aye: Neuzil, Stutsman, Lehman, Thompson; nay: Harney.
