MINUTES OF THE CANVASS OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

NOVEMBER 12 AND 14, 2002

Chairperson Thompson called to order the Johnson County Board of Supervisors at 3:00 p.m. to act as a canvass board to certify the results of the General Election of November 5, 2002. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Deputy Auditor John Deeth reported that Auditor Tom Slockett had received a call from the Iowa Democratic Party at 2:45 p.m. reporting that a number of sealed Johnson County absentee ballots which had not been delivered to the Johnson County Auditor’s Office had been discovered at party headquarters in Des Moines.

Recessed at 3:12 p.m.; reconvened at 3:17 p.m.

Deeth reported that there were 44 ballots found at Democratic headquarters in Des Moines which had not been returned to the Auditor’s Office, and these ballots were being delivered to the Auditor’s Office immediately at the request of Auditor Slockett.  He said Slockett was currently on the phone to the Secretary of State and Attorney General to determine whether these ballots could be counted.

Recessed at 3:20 p.m.; reconvened on Thursday, November 14, 2002 at 4:08 p.m.

Deeth said the Attorney General’s office had called Slockett back shortly after the Board recessed and had determined that the ballots found at Iowa Democratic Party headquarters could not be counted.  The 44 ballots had arrived at the Auditor’s Office by 5 p.m. on November 12.  Deeth said Slockett was making every effort to determine how and why the problem had occurred and who was responsible.

FOR THE OFFICE OF UNITED STATES SENATOR there were thirty-eight thousand six hundred nineteen (38,619) votes cast as follows:

Tom Harkin received twenty-four thousand nine hundred sixty-five (24,965) votes, Greg Ganske received twelve thousand three hundred fifteen (12,315) votes, Timothy A. Harthan received nine hundred sixty (960) votes, Richard J. Moore received three hundred sixty (360) votes, and Scattering received nineteen (19) votes.

FOR THE OFFICE UNITED STATES REPRESENTATIVE SECOND DISTRICT there were thirty-eight thousand five hundred seventeen (38,517) votes cast as follows:

Julie Thomas received eighteen thousand two hundred ninety-eight (18,298) votes, Jim Leach received nineteen thousand four hundred fifty-five (19,455) votes, Kevin Litten received seven hundred thirty-nine (739) votes, and Scattering received twenty-five (25) votes.

FOR THE OFFICE OF GOVERNOR there were thirty-eight thousand six hundred twenty-two (38,622) votes cast as follows:

Tom Vilsack received twenty-four thousand two hundred seventy-eight (24,278) votes, Doug Gross received twelve thousand three hundred seventy-seven (12,377) votes, Jay Robinson received one thousand two hundred eighty-eight (1,288) votes, Clyde Cleveland received six hundred forty-one (641) votes, and Scattering received thirty-eight (38) votes.

FOR THE OFFICE OF SECRETARY OF STATE there were thirty-seven thousand two hundred sixty-three (37,263) votes cast as follows:

Chet Culver received twenty-two thousand seven hundred eighty-five (22,785) votes, Mike Hartwig received eleven thousand six hundred seventy-six (11,676) votes, Don Arenz received one thousand nine hundred eighty-eight (1,988) votes, Sylvia Sanders Olson received eight hundred two (802) votes, and Scattering received twelve (12) votes.

FOR THE OFFICE OF AUDITOR OF STATE there were thirty-six thousand two hundred fifty-two (36,252) votes cast as follows:

Patrick J. Deluhery received twenty-one thousand one hundred ninety-one (21,191) votes, David Vaudt received twelve thousand eight hundred seventy-two (12,872) votes, Christy Ann Welty received two thousand one hundred seventy (2,170) votes, and Scattering received nineteen (19) votes.

FOR THE OFFICE OF TREASURER OF THE STATE there were thirty-six thousand six hundred seventy-one (36,671) votes cast as follows:

Michael L. Fitzgerald received twenty-two thousand six hundred fifty-five (22,655) votes, Matt Whitaker received twelve thousand seven hundred sixty-six (12,766) votes, Tim Hird received one thousand two hundred thirty-two (1,232) votes, and Scattering received eighteen (18) votes.

FOR THE OFFICE OF SECRETARY OF AGRICULTURE there were thirty-six thousand seven hundred forty-four (36,744) votes, cast as follows:

Patty Judge received twenty thousand seven hundred twenty-nine(20,729) votes, John Askew received twelve thousand two hundred eighty-two (12,282) votes, Brian Russell Depew received two thousand seven hundred two (2,702) votes, Fritz Groszkruger received four hundred eighty-one (481) votes, Ronald Tigner received five hundred forty (540) votes, and Scattering received ten (10) votes.

FOR THE OFFICE OF ATTORNEY GENERAL there were thirty-seven thousand three hundred eleven (37,311) votes as follows:

Tom Miller received twenty-five thousand eight hundred sixty-five (25,865) votes, Dave Millage received ten thousand two hundred ninety-seven (10,297) votes, Edward F. Noyes received one thousand one hundred twenty-seven (1,127) votes, and Scattering received twenty-two (22) votes.

FOR THE OFFICE OF STATE SENATOR (15th Dist.) there were fifteen thousand four hundred thirty-three (15,433) votes cast as follows:

Robert E. Dvorsky received nine thousand four hundred nine (9,409) votes, Jack Young received six thousand fifiteen (6,015) votes, and Scattering received nine (9) votes.

FOR THE OFFICE OF STATE SENATOR (39th Dist.) there were fourteen thousand eight hundred four votes cast as follows:

Joe Bolkcom received fourteen thousand five hundred fifty-nine (14,559) votes and Scattering received two hundred forty-five (245) votes.

FOR THE OFFICE OF STATE SENATOR (40thDist.) there were seven hundred thirty-four (734) votes cast as follows:

Thomas L. Fiegen received four hundred thirty-three (433) votes, Richard F. Drake received two hundred ninety-nine (299) votes, and Scattering received two (2) vote.

FOR THE OFFICE OF STATE SENATOR (45th Dist.) there were two thousand two hundred (2,200) votes cast as follows:

Mark Shearer received one thousand two hundred forty-seven (1,247) votes, David Miller received nine hundred forty-nine (949) votes, and Scattering received four (4) votes.

FOR THE OFFICE OF STATE REPRENSENTATIVE (29th Dist.) there were three thousand nine hundred twenty-three (3,923) votes cast as follows:

Ro Foege received three thousand eight hundred seventy (3,870) votes and Scattering received fifty-three (53) votes.

FOR THE OFFICE OF STATE REPRESENTATIVE (30th Dist.) there were nine thousand nine hundred fifteen (9,915)) votes cast as follows:

Dick Myers received six thousand four hundred twenty (6,420) votes, Paul E. Knupp Jr. received three thousand four hundred eighty-two (3,482) votes, and Scattering received thirteen (13) votes.

FOR THE OFFICE OF STATE REPRESENTATIVE (77th Dist.) there were five thousand four hundred eighty-two (5,482) votes cast as follows;

Mary Mascher received five thousand three hundred ninety-four (5,394) votes, and Scattering received eighty-eight (88) votes.

FOR THE OFFICE OF STATE REPRESENTATIVE (79th Dist.) there were seven hundred thirty-seven (737) votes cast as follows:

Mike Owens received four hundred thirty (430) votes, Dan Boddicker received three hundred seven (430) votes, and Scattering received no (0) votes.

FOR THE OFFICE OF STATE REPRESENTATIVE (89th Dist.) there were two thousand one hundred fifty-seven (2,157) votes cast as follows;

Jo Ann Zager received one thousand one hundred thirty-four (1,134) votes, Sandra H. Greiner received one thousand twenty (1,020) votes, and Scattering received three (3) votes.

FOR THE OFFICE OF County Board of Supervisors (TWO to be elected) there were fifty-six thousand two hundred three (56,203) votes cast as follows:

Mike Lehman received twenty-four thousand six hundred seventy-six (24,676) votes, Sally Stutsman received twenty-four thousand four hundred two (24,402) votes, Joannes Raymond Pool received six thousand eight hundred eighty-two (6,882) votes, and Scattering received two hundred forty-three (243) votes; and Michael E. Lehman and Sally Stutsman were elected.

FOR THE OFFICE OF County Treasurer there were twenty-nine thousand eight hundred twenty-nine (29,829) votes cast as follows:

Thomas L. Kriz received twenty-nine thousand five hundred eighty-seven (29,587) votes and Scattering received two hundred forty-two (242) votes; and Thomas L. Kriz was elected.

FOR THE OFFICE OF County Recorder there were twenty-eight thousand four hundred eleven (28,411) votes cast as follows:

Kim Painter received twenty-eight thousand one hundred fourteen (28,114) votes and Scattering received two hundred ninety-seven (297) votes; and Kim Painter was elected.

FOR THE OFFICE OF County Attorney there were twenty-eight thousand nine hundred thirty-two (28,932) votes cast as follows:

J. Patrick White received twenty-eight thousand three hundred seventy-three (28,373) votes and Scattering received five hundred fifty-nine (559) votes; and J. Patrick White was elected.

FOR THE OFFICE OF Big Grove Township Clerk there were five hundred seventy (570) votes cast as follows:

DeWayne D. Klouda received five hundred sixty-seven (567) votes and Scattering received three (3) votes; and DeWayne D. Klouda was elected.

FOR THE OFFICE OF Big Grove Township Trustee (ONE to be elected) there were five hundred sixty-seven (567) votes cast as follows:

Elmer J. Vanorny received five hundred sixty-five (565) votes and Scattering received two (2) votes; and Elmer J. Vanorny was elected.

FOR THE OFFICE OF Cedar Township Clerk there were two hundred twenty (220) votes cast as follows:

Randy Brannaman received two hundred twenty (220) votes: and Randy Brannaman was elected.

FOR THE OFFICE OF Cedar Township Trustee (ONE to be elected) there were two hundred twenty-three (223) votes cast as follows:

Gene Greazel received two hundred twenty-one (221) votes and Scattering received two (2) votes; and Gene Greazel was elected.

FOR THE OFFICE OF Clear Creek Township Clerk there were one hundred nine (109) votes cast as follows:

Patricia Pirkl received one hundred nine (109) votes; and Patricia Pirkl was elected.

FOR THE OFFICE OF Clear Creek Township Trustee (ONE to be elected) there were one hundred eleven (111) votes cast as follows:

Donald Pirkl received one hundred eleven (111) votes; and Donald Pirkl was elected.

FOR THE OFFICE OF East Lucas Township Clerk there were one hundred seventy-six (176) votes cast as follows:

Christopher W. Knapp received one hundred seventy-six (176) votes; and Christopher W. Knapp was elected.

FOR THE OFFICE OF East Lucas Township Trustee (ONE to be elected) there were seven (7) votes cast as follows:

Jay Christensen-Szalanski received one (1) vote, Chuck Doak received one (1) vote; Lawrence Hebl received one (1) vote, Jerry Meis received one (1) vote, Randy Moore received one (1) vote, and Scattering received three (3) votes; and Chuck Doak was elected as determined by lot according to Chapter 50.44 of the Code of Iowa, as amended.

FOR THE OFFICE OF East Lucas Township Trustee - To Fill a Vacancy (ONE to be elected) there were three (3) votes cast as follows:

Randy Moore received one (1) vote, Pam Terrill received one (1) vote, and Scattering received one (1) vote; and Pam Terrill was elected as determined by lot according to Chapter 50.44 of the Code of Iowa, as amended.

FOR THE OFFICE OF Fremont Township Clerk there were one hundred thirteen (113) votes cast as follows:

Laura Yochem received one hundred eleven (111) votes and Scattering received two (2) votes; and Laura Yochem was elected.

FOR THE OFFICE OF Fremont Township Trustee (ONE to be elected) there were one hundred nine (109) votes cast as follows:

Gene Zdrazil received one hundred nine (109) votes; and Gene Zdrazil was elected.

FOR THE OFFICE OF Graham Township Clerk (ONE to be elected) there were one hundred sixty-eight (168) votes cast as follows:

Tom Wall received one hundred sixty-eight (168) votes; and Tom Wall was elected.

FOR THE OFFICE OF Graham Township Trustee (ONE to be elected) there were one hundred seventy-four (174) votes cast as follows:

FOR THE OFFICE OF Lincoln Township Trustee (ONE to be elected) there were eighty-four (84) votes cast as follows:

Marvin Hotz received eighty-four (84) votes; and Marvin Hotz was elected.

FOR THE OFFICE OF Madison Township Clerk (ONE to be elected) there were one hundred forty (140) votes cast as follows;

Beth Saxton received one hundred thirty-six (136) votes and Scattering received four (4) votes; and Beth Saxton was elected.

FOR THE OFFICE OF Madison Township Trustee (ONE to be elected) there were one hundred forty-seven (147) votes cast as follows:

Gary A. Swenka received one hundred forty-seven (147) votes; and Gary A. Swenka was elected.

FOR THE OFFICE OF Monroe Township Clerk (ONE to be elected) there were one hundred seventy (170) votes cast as follows:

FOR THE OFFICE OF Sharon Township Trustee (ONE to be elected) there were two hundred one (201) votes cast as follows;

FOR THE OFFICE OF Union Township Clerk (ONE to be elected) there were one hundred fifty-one (151) votes cast as follows:

FOR THE OFFICE OF Union Township Trustee (ONE to be elected) there were two hundred sixty (260) votes cast as follows:

Vernon Brogla received two hundred fifty-nine (259) votes and Scattering received one (1) vote; and Vernon Brogla was elected.

FOR THE OFFICE OF Washington Township Clerk (ONE to be elected) there were one hundred eighty-seven (187) votes cast as follows:

James M. Yoder received one hundred eighty-four (184) votes and Scattering received three (3) votes; and James M. Yoder was elected.

FOR THE OFFICE OF Washington Township Trustee (ONE to be elected) there were one hundred ninety-eight (198) votes cast as follows:

Cindy Asmussen received eighteen thousand four hundred twenty-one (18,421) votes, Gene Kasper received eighteen thousand one hundred one (18,101) votes, and Scattering received two hundred (200) votes; and Cindy Asmussen and Gene Kasper were elected.

FOR THE OFFICE OF Soil and Water Conservation Board – To Fill Vacancy (ONE to be elected) there were one thousand seventy-three (1,073) votes cast as follows:

Dave Parsons received thirty-two (32) votes, and Scattering received one thousand forty-one (1,041) votes; and Dave Parsons was elected.

FOR THE OFFICE OF Agricultural Extension Council Member (FIVE to be elected) there were ninety-four thousand six hundred eighty-nine (94,689) votes cast as follows:

Greg Finger received eighteen thousand six hundred seventeen (18,617) votes, Pam Loan received nineteen thousand six hundred forty-five (19,645) votes, Denise Maier received nineteen thousand one hundred forty-five (19,145) votes, Bill Terry received eighteen thousand four hundred forty-two (18,442) votes, Andrew Viner received eighteen thousand five hundred thirty-seven (18,537) votes, and Scattering received three hundred three (303) votes; and Greg Finger, Pam Loan, Denise Maier, Bill Terry and Andrew Viner were elected.

FOR THE OFFICE OF Agricultural Extension Council Member (To Fill A Vacancy) (ONE to be elected) there were twenty-one thousand three hundred six (21,306) votes cast as follows:

Russ Wise received twenty-one thousand two hundred two (21,202) votes, and Scattering received one hundred four (104) votes; and Russ Wise was elected.

On the question "Shall the following Supreme Court Justices be retained in office?": Marsha Ternus received nineteen thousand seven hundred sixty-one (19,761) votes in favor of retention, four thousand six hundred seventy-one (4,671) opposed; and Michael J. Streit received eighteen thousand nine hundred fifty-seven (18,957) votes in favor of retention, four thousand nine hundred eight (4,908) opposed.

On the question "Shall the following Court of Appeals Judges be retained in office?": Terry L. Huitink received eighteen thousand three hundred thirty-one (18,331) votes in favor of retention, four thousand seven hundred (4,700) opposed; Rosemary Shaw Sackett received nineteen thousand seventy-nine (19,079) votes in favor of retention, four thousand six hundred eighty-two (4,682) opposed; and Larry J. Eisenhauer received eighteen thousand two hundred fifty-seven (18,257) votes in favor of retention, four thousand seven hundred fifty-eight (4,758) opposed.

On the question "Shall the following District Court Judges be retained in office?": Amanda Potterfield received nineteen thousand three hundred thirty-six (19,336) votes in favor of retention, four thousand six hundred eight (4,608) opposed; Patrick R. Grady received nineteen thousand five hundred twelve (19,512) votes in favor of retention, four thousand six hundred forty-two (4,642) opposed; and Thomas L. Koehler received eighteen thousand five hundred ninety-one (18,591) votes in favor of retention, four thousand seven hundred twenty-two (4,722) opposed.

On the question "Shall the following District Court Associate Judges be retained in office?": Sylvia A. Lewis received twenty thousand ninety-three (20,093) votes in favor of retention, four thousand four hundred fifty-seven (4,457) opposed; and Jane F. Spade received eighteen thousand nine hundred seventy-three (18,973) votes in favor of retention, four thousand five hundred three (4,503) opposed.
