MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

APRIL 3, 2003

Chairperson Harney called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Pat Harney, Mike Lehman, Terrence Neuzil, Sally Stutsman, and Carol Thompson.

Unless otherwise noted, all actions were taken unanimously.

Motion by Neuzil, second by Stutsman, to approve the claims on the Auditor’s Claim Register, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Lehman, to approve the minutes of the formal meetings of March 27, 2003 and April 2, 2003. Roll call: aye: Neuzil, Stutsman, Harney, Lehman; abstain: Thompson.

Motion by Lehman, second by Thompson, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

RESOLUTION NO.04-03-03-N1

Amending Resolution No. 03-27-03-N1 with respect to amount of debt service levy to pay principal and interest on $3,570,000 General Obligation Capital Loan Note, Series 2003

Whereas, pursuant to the provisions of Section 331.402 of the Code of Iowa, and Board Resolution No. 03-27-03-N1, adopted March 27, 2003, the Board of Supervisors of Johnson County, Iowa (the "County"), has approved the issuance of a $3,570,000 General Obligation Capital Loan Note, Series 2003 ( the "Note"); and

Whereas, it is necessary at this time to amend Resolution No. 03-27-03-N1 with respect to the amount of the debt service property tax levy which was set out in said Resolution;

Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as follows:

Section 1. Section 5 of Resolution No. 03-27-03-N1, adopted on March 27, 2003, is hereby amended to read as follows:

"Section 5.For the purpose of providing for the levy and collection of a direct annual tax sufficient to pay the principal of and interest on the Note as the same become due, there is hereby ordered levied on all the taxable property in the County for the year while the Note is outstanding, a tax sufficient for that purpose, and in furtherance of this provision, but not in limitation thereof, there is hereby levied on all the taxable property in the County the following direct annual tax:

For collection in the fiscal year beginning July 1, 2003 sufficient to produce the net annual sum of $3,616,301."

Section 2. A certified copy of this resolution shall be filed with the County Auditor, and said Auditor shall be and is hereby instructed to enter for collection and assess the tax hereby authorized. When annually entering such taxes for collection, the County Auditor shall include the same as a part of the tax levy for Debt Service Fund purposes of the County and when collected, the proceeds of the taxes shall be converted into the Debt Service Fund of the County and set aside therein as a special account to be used solely and only for the payment of the principal of and interest on the Note hereby authorized and for no other purpose whatsoever.

Section 3. All resolutions or parts thereof in conflict herewith be and the same are hereby repealed to the extent of such conflict.

Motion by Thompson, second by Neuzil, to approve Resolution 04-03-03-N1.

PROCLAMATION 04-03-03-01

Whereas, today’s children are tomorrow’s leaders; and

Whereas, there are over 6,400 children age birth to five years living in Johnson County; and

Whereas, high quality early experiences make a difference in children’s lifelong academic and social success; and

Whereas, Iowa ranks second in the nation in the number of working parents with children up to age of five years; and

Whereas, over 90% of brain development occurs in the first three years of life; and

Whereas, children’s opportunities are our responsibilities;

Now, Therefore, I, Pat Harney, Chairperson of the Johnson County Board of Supervisors, do hereby proclaim that Johnson County join with others across our nation and around the world to celebrate April 6 through April 13, 2003, as the

Week of the Young Child

I urge all citizens to recommit ourselves to ensuring that each and every child experiences the type or early environment-at home, at childcare, at school, and in the community-that will promote their early learning.

Motion by Stutsman, second by Thompson, to approve Proclamation 04-03-03-01.

PROCLAMATION 04-03-03-02

Whereas, crime and the threat of violence have profound and devastating effects on individuals, families and communities in America; and

Whereas, over 24 million people in the United States are touched by crime each year; and

Whereas, crime in America results in significant physical, psychological, financial and spiritual effects on countless innocent victims; and

Whereas, crime victims in every state, U.S. territories and Federal jurisdictions have statutory rights to be kept informed of and involved in criminal juvenile justice processes, and to be afforded protection, restitution and accountability from their offenders; and

Whereas, there are over 10,000 community-and system-based victim service programs across our nation that provide a wide range of services and support to victims of crime; and

Whereas, in 2003, the Office for Victims of Crime within the U.S. Department of Justice commemorates 20 years of providing leadership to ensure that crime victims are treated with dignity and compassion; and

Whereas, America as a nation continues to face threats to our personal and public safety, and continues to commit its collective energies to help our fellow citizens who are hurt by crime;

Now, Therefore, Be it Resolved, I, Pat Harney, Chairperson of the Johnson County Board of Supervisors, proclaims the week of April 6-April 12, 2003 to be

Crime Victims’ Week

and honors crime victims and those who serve them during this week and throughout the year; and

Be it Further Resolved, that we continue to fulfill the promise of justice and compassion for crime victims as individuals, as communities, and as a nation dedicated to justice for all.

PROCLAMATION 04-03-03-03

MAYOR’S YOUTH EMPLOYMENT PROGRAM MONTH

APRIL 2, 2003

Whereas, Mayor’s youth Employment Program was created in 1968 to provide employment opportunities for area young people; and

Whereas, Mayor’s Youth Employment Program has provided valuable services to area youth over these 35 years, including paid employment, career counseling, career exploration, on the job training, job seeking skills, resume writing, interviewing skills, time management, following directions, anger management, volunteer opportunities, like skills training, daycare, supported community living, and respite; and

Whereas, the Mayor’s Youth Employment Program Bike Shop has allowed scores of local youth an opportunity to learn valuable skills, while at the same time keeping bikes from the landfill and putting them in the hands of individuals who need them; and

Whereas, literally thousands of area youth have spent one or more summers working for Mayor’s Youth Employment Program, gaining real world experience and skills; and

Whereas, these youth have provided vital labor for many public works projects, including the Ped Mall, Sockum Ridge Park, Roosevelt Elementary, the Johnson County Fairgrounds, Camp Cardinal, local bus stops, the Hoover Museum, and the Coralville Reservoir; and

Whereas, Mayor’s Youth Employment Program continues to provide advocacy and support to youth and their families who face barriers to independence;

Now, Therefore, I, Pat Harney, Chairperson of the Johnson County Board of Supervisors, hereby recognize the Mayor’s Youth Employment Program for 35 years of outstanding service to Johnson County and the surrounding area, and proclaim April, 2003, to be Mayor’s Youth Employment Program month in Johnson County.

Motion by Thompson, second by Stutsman, to approve Proclamation 04-03-03-03.

Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign the proposed 28E Agreement between Cedar County and Johnson County for Mutual Police Protection.

Motion by Lehman, second by Stutsman, to approve and authorize the Auditor to publish a Notice to Bidders setting a bid letting date of May 13, 2003 at 10:00 a.m. for bituminous resurfacing (oil contract) of various Johnson County Secondary Roads located throughout the County.

Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Johnson County Secondary Road Five-year Construction Program for submittal to the Iowa Department of Transportation and the future projects list.

Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the Johnson County Secondary Road budget for submittal to the Iowa Department of Transportation.

Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign the uniform payroll schedule and authorize Human Resources to send letters to employees.

Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the payroll processing policy to replace the policy in the Johnson County Employee Handbook.

Motion by Lehman, second by Thompson, to designate Emergency Management Agency Coordinator Tom Hansen as the contact for Homeland Security with Johnson County.

Motion by Stutsman, second by Neuzil, to approve and authorize the Chairperson to sign the letter of support for Families, Schools, Community Acting Together Grant Application (Drug and Violence Prevention through the Iowa Department of Public Health) request for Iowa Department of Health funding.
