MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

SEPTEMBER 10, 1998

Chairperson Bolkcom called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 5:34 p.m. Members present were: Joseph Bolkcom, Charles Duffy, Jonathan Jordahl, Stephen Lacina, and Sally Stutsman.

Unless otherwise noted, all actions were taken unanimously.

Motion by Lacina, second by Duffy, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Lacina, to approve the minutes of the formal meeting of September 3, 1998.

Motion by Duffy, second by Lacina, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Jordahl, second by Stutsman, to authorize the County Attorney to begin condemnation proceedings for right-of-way to be acquired from James H. Ronan and Wanda E. Ronan for Johnson County Project L-U-16-1 (RCB Culvert and approach grading on 640th Street and Utah Avenue in Section 16-77-5).

Recessed to informal meeting of September 8 and 10, 1998 at 5:37 p.m.

Reconvened as a Public Hearing on Zoning and Platting Applications at 6:00 p.m.

Application Z9834 of Keith Hemann, Iowa City, Iowa, requesting rezoning of 2.70 acres from CP-2 Planned Commercial District to M-1 Light Industrial of certain property described as being Lot 1 & 2 of Scott's Fourth Addition located in the SE 1/4 of the SW 1/4 of Section 20; Township 79 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This property is located in the SW quadrant of Naples Avenue SW and Alyssa Court SW in West Lucas Twp.)

Planning and Zoning Administrator Rick Dvorak reported that Application Z9834 has been withdrawn by the applicant.

Application Z9835 of Cask Farms, an Iowa General Partnership, signed by Kenneth Musser, Hills, Iowa, requesting rezoning of 1.78 acres from A1 Rural to RS Suburban Residential of certain property described as being in the NE 1/4 of Section 23 and the NW 1/4 of Section 24; all in Township 78 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This property is located on the west side of Sand Road SE, approximately 1/2 mile south of 520th Street SE in Pleasant Valley Twp.)

Glen Meisner of MMS Consultants, Inc. was present to answer questions.

Motion by Lacina, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve Application Z9835 on first and second consideration. Roll call: aye: Jordahl, Stutsman, Bolkcom, Lacina, Duffy.

Application S9818 of William E Wilford requesting preliminary and final plat approval of Wilford's Fifth Addition, a subdivision described as being located in the SE 1/4 of the SE 1/4 of Section 9; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 2-lot, 2.50 acres, residential subdivision, located on the west side of James Avenue NE, approximately 3/4 of a mile south of 120th Street NE in Jefferson Twp.)

Glen Meisner of MMS Consultants, Inc. spoke for the application.

Assistant Planning and Zoning Administrator R.J. Moore recommended that no future plats be considered for this applicant until a concept plan is submitted for the remaining undeveloped land.

RESOLUTION 09-10-98-Z1

APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF WILFORD'S FIFTH ADDITION,

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9818 for approval of a preliminary and final plat of Wilford's Fifth Addition, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

Application S9826 of Tom Brennan requesting preliminary and final plat approval of Brennan's First Addition, a subdivision described as being located in the SE 1/4 of the SW 1/4 of Section 12; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 2.39 acre, residential subdivision, located on the west side of Hickory Hollow Road NE, one mile south of 120th Street NE in Jefferson Twp.)

Tom Anthony of Landmark Surveying and Engineering was present to answer questions.

RESOLUTION 09-10-98-Z2

APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF BRENNAN'S FIRST ADDITION,

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9826 for approval of a preliminary and final plat of Brennan's First Addition, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

Application S9836 of Marie Anderson requesting preliminary and final plat approval of Anderson Farms Addition, a subdivision described as being located in the SW 1/4 of the SW 1/4 of Section 10; Township 81 North; Range 8 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 1.46 acre, residential subdivision, located on the north side of 140th Street NW, approximately 1/2 mile east of its intersection with Chambers Avenue NW in Monroe Twp.)

Marie Anderson was present to answer questions.

RESOLUTION 09-10-98-Z3

RESOLUTION APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF ANDERSON'S FARMS ADDITION,

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9836 for approval of a preliminary and final plat of Anderson Farms Addition, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

Motion by Lacina, second by Stutsman, to approve Resolution 09-10-98-Z3, subject to the applicant, prior to issuance of a building permit, submitting a notarized statement that the existing structures will be removed.

Application S9838 of Scott and Kelly Breese requesting preliminary and final plat approval of Bailey's Run Addition, a subdivision described as being located in the NE 1/4 of Section 25; Township 81 North; Range 5 West of the 5th P.M. in Johnson County, Iowa (This is a 1-lot, 5.528 acre, residential subdivision, located on the east side of St. Bridgets Road NE, approximately 1/4 of a mile south of 180th Street NE in Cedar Twp.)

Jim Jacob of Vanwinkle-Jacob Engineering, Inc. was present to answer questions.

RESOLUTION 09-10-98-Z4

APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF BAILEY'S RUN ADDITION,

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9838 for approval of a preliminary and final plat of Bailey's Run Addition, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

Motion by Lacina, second by Duffy, to approve Resolution 09-10-98-Z4.

Application S9839 of J. Donald and Sherry Johnson, signed by Donald Johnson, requesting preliminary and final plat approval of Johnson's Cove, a subdivision located in the SW 1/4 of the SE 1/4 of Section 18; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This is a 3-lot, two residential and one farmstead split, 19.88 acre, residential subdivision, located on the east side of Blain Cemetery Road NW, approximately 3/4 of a mile south of Seneca Road NW in Jefferson Twp.)

Don Johnson spoke for the application.

Jordahl asked for the applicant's cooperation in any possible future road realignment to reduce the sharp curve.

RESOLUTION 09-10-98-Z5

APPROVING THE PRELIMINARY AND FINAL PLAT AND SUBDIVIDER'S AGREEMENT OF JOHNSON'S COVE,

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9839 for approval of a preliminary and final plat of Johnson's Cove, and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.

3. This Resolution requires the recording of the following documents: Approval of Swisher; Owner Certificate; Title Opinion; Treasurer's Certificate; Subdivider's Agreement; Fence Agreement; Resolution Affirming the Stability of the Current Road System

Motion by Lacina, second by Duffy, to approve Resolution 09-10-98-Z5.

Application S9842 of Mike Dombroski, signed by Mike Dombroski and Tom Anthony of Landmark Surveying and Engineering, requesting preliminary plat approval of Prairie Meadows Part 2 (A Resubdivision of Lot 1 Prairie Meadows and a portion of the NE 1/4 of the SE 1/4 of 34 - 80 - 6), a subdivision described as being located in the SE 1/4 of Section 34; Township 80 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This is a 11-lot, approximately 16 acres, 7 residential lot with 4 outlot subdivision, located on the east side of Prairie du Chien Road NE, approximately 1/8 of a mile north of its intersection with Linder Road NE in East Lucas Twp.)

Tom Anthony of Landmark Surveying and Engineering spoke for the application. Mary Cole was present with questions concerning the realignment of Prairie du Chien Road.

Assistant Planning and Zoning Administrator R.J. Moore reported that plans for a realignment of Prairie du Chien Road need to be completed prior to the applicant completing an acquisition plat. In reply to Bolkcom's question concerning the possibility of asking for a bus turn-around, Moore said the road has a low speed, there are a number of stops made along the road, and there is currently no requirement in the ordinances to require a turn-around. Bolkcom asked Moore to seek feedback from the school bus company. In reply to Jordahl's question concerning the possibility of centralizing septic and water systems, Moore said, though he often recommends shared wells and septic systems, he would have to defer to the Department of Public Health.

RESOLUTION 09-10-98-Z6

APPROVING THE PRELIMINARY PLAT AND SUBDIVIDER'S AGREEMENT OF PRAIRIE MEADOWS PART 2

(A RESUBDIVSION OF LOT 1 PRAIRIE MEADOWS AND A PORTION

OF THE NE ¼ OF THE SE ¼ OF 34-80-6),

JOHNSON COUNTY, IOWA

Whereas, the owner has filed application S9842 for approval of a preliminary plat of Prairie Meadows Part 2 (A Resubdivision of Lot 1 Prairie Meadows and a portion of the NE ¼ of the SE ¼ of 34-80-6), and

Whereas, the County Zoning Commission having studied said application recommends that the plat be approved.

Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa:

1. That said plat be approved.

2. That the Chairperson be directed to sign said plat.

Motion by Lacina, second by Duffy, to approve Resolution 09-10-98-Z6, subject to the submittal of acquisition plat and right-of-way easement documents, meeting Department of Public Health requirements, and to look at the possibility of creating a school bus pull-off prior to the final platting.
