MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

DECEMBER 3, 1998

Chairperson Bolkcom called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:05 a.m. Members present were: Joseph Bolkcom, Charles Duffy, Jonathan Jordahl, Stephen Lacina, and Sally Stutsman.

Unless otherwise noted, all actions were taken unanimously.

Motion by Stutsman, second by Jordahl, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors. Roll call: aye: Bolkcom, Jordahl, Stutsman, Duffy; abstain: Lacina.

Motion by Duffy, second by Lacina, to approve the formal minutes of the November 10, 1998 canvass of votes for the General Election and November 16, 1998 canvass for East Central Regional Library Trustee, and the formal minutes of November 17, 1998.

Motion by Lacina, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

Motion by Lacina, second by Stutsman, to approve and authorize the Chairperson to sign the following permits:

Retail Cigarette Permit for Swisher Gas-N-Go, Swisher, as submitted by Raelyn Netolicky;

Renewal Application For Class C Beer Permit and Application for Sunday Sales Privilege for I-380 Citgo, Swisher, as submitted by Barbara S. Clark and James M. Bryson.

Application Z9841 of Ronald L. Rushek and Raymond J. Randall, Trustee, Solon, Iowa, signed by Ronald Rushek, requesting rezoning of 87 1/2 acres from A-1 Rural to RS Suburban Residential of certain property described as being in the SW 1/4 of Section 19; Township 81 North; Range 5 West of the 5th P.M. in Johnson County, Iowa (This property is located on the north side of 180th Street NE, approximately 1/2 mile east of the city limits of Solon, Iowa in Big Grove and Cedar Twp.)

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A1 TO RS

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from A1 to RS.

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Big Grove and Cedar Townships and comprised of approximately 10 acres to wit:

Commencing at the Southwest corner of the east 13.89 acres of the Southeast one-quarter of Section 24 Township 81 North, Range 6 West of the Fifth Principal Meridian, Johnson County, Iowa; Thence North along the west line of said east 13.89 acres, 40 feet to a point on the northerly right-of-way line of 180th Street NE and the Point of Beginning; Thence continuing North along said west line, 664 feet; Thence East, 447 feet; Thence SE'ly, 512 feet to a point 252 feet north from said northerly right-of-way line; Thence South, 252 feet to a point on said northerly right-of-way line; Thence West, along said northerly right-of-way line, 750 feet to said Point of Beginning, containing 10 acres and subject to easements and restrictions of record.

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Article V, Section 2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

On November 12, 1998, motion by Duffy, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve Application Z9841 on first and second consideration. The motion was tabled and the public hearing continued until November 17, 1998.

On November 17, 1998, motion by Lacina, second by Stutsman, to amend the application to 10 acres to be rezoned RS, leaving the remainder A1 and to waive the requirement of three considerations before amending an ordinance and to approve Application Z9841 on first and second consideration. Roll call: aye: Jordahl, Stutsman, Bolkcom, Lacina, Duffy.

RESOLUTION 12-03-98-Z1

SETTING PUBLIC HEARING ON JOHNSON COUNTY LAND USE PLAN

Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on December 3 and 7, 1998 filed its report and recommendations on the Johnson County Land Use Plan;

Now, therefore, be it resolved as follows:

A public hearing in accordance with Section 335.6 of the Iowa Code is set for the 17th day of December, 1998 at 7:00 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the Johnson County Land Use Plan

That the Johnson County Auditor be authorized to publish the official notice of the above public hearing.

Motion by Lacina, second by Stutsman, to approve Resolution 12-03-98-Z1.

Motion by Lacina, second by Stutsman, to approve Heritage Agency on Aging's request for proposals for Senior Dining Transportation.

Motion by Stutsman, second by Lacina, establishing Johnson County SEATS Para-Transit Advisory Committee.

Motion by Lacina, second by Stutsman, to appointment Joshua Maclean, and Daniel Morse as Reserve Deputy Sheriffs: (As recommended by Sheriff Carpenter).

Motion by Lacina, second by Stutsman, to authorize the Chairperson to send letters of congratulations to the following: Regina High School Boys' Cross Country Team and Coaches for winning the State Class 1A championship; Michelle Lilienthal and Coach Steve Sherwood at City High School for winning the State Cross Country individual championship; City High Girls' Volleyball Team and Coaches for winning the State Class 3A Volleyball championship; Iowa City West High Football Team and Coaches for winning the Class 4A Boys' championship game in the state football playoffs; and Iowa City West High Cross Country Track Team and Coaches for winning the Class 4A Girls' State Cross Country Track Championship.

PROCLAMATION 12-03-98-01

PROCLAIMING "MAKE-A-WISH-WEEK"

November 30th to December 4, 1998, the Make-A-Wish Foundation of Iowa is celebrating "Make-A-Wish Week" throughout the state of Iowa.

The Make-A-Wish Foundation of Iowa is a non-profit organization that fulfills wishes for children between the ages of 2 1/2 and 18 who have diagnosed life-threatening illnesses. The Iowa Chapter of the national foundation was founded in 1986. Since then, over 650 wishes have been granted to Iowa children battling life-threatening conditions (102 during the past 12 months alone).

The Make-A-Wish Foundation of Iowa is a volunteer driven organization. In the coming year, 17 Board of Directors, 13 Area Committees, and over 400 volunteers will donate their time and talent to the cause of fulfilling wishes to an estimated 115 ill children in Iowa. Volunteers outnumber paid staff by a ratio of more than 100 to 1, as there are only 4 paid staff in Iowa.

During the week-long celebration, volunteer groups throughout Iowa will hold fundraising and public awareness activities. The Iowa Bankers Association and its member banks will begin a month-long fundraising effort to sponsor local wishes through the sale of paper cutouts at local banks for $1.00 each.

NOW, THEREFORE, BE IT PROCLAIMED THAT I, Joe Bolkcom, Chairperson of the Johnson County Board of Supervisors, do hereby declare November 30th to December 4, 1998 as "MAKE-A-WISH WEEK."

Motion by Jordahl, second by Stutsman, to approve Proclamation 12-03-98-01.

Motion by Duffy, second by Lacina, to approve family farm tax credits for 1998 as recommended by the City Assessor.
