DECEMBER 17, 1998
Chairperson Bolkcom called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:10 a.m. Members present were: Joseph Bolkcom, Charles Duffy, Jonathan Jordahl, and Sally Stutsman; Steve Lacina arrived at 9:12 a.m.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Jordahl, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors. Roll call: aye: Jordahl, Stutsman, Bolkcom, Duffy; absent: Lacina.

Whereas the Johnson County Planning and Zoning Commission, following a public hearing, on December 14, 1998 filed its report and recommendations for certain actions;
Now, therefore, be it resolved as follows:

An amendment to the Johnson County Zoning Ordinance, Chapter 8:1.34, Conditional Use Permits by deleting the following:
4. Home Businesses are permitted in the A and R districts subject to the following supplemental conditions:
a) The home business, its materials, supplies, and products shall occur in and be confined to the dwelling or the permitted accessory building or buildings located on the premises.
b) There shall be no advertising on the premises other than a small sign not to exceed four (4) square feet in Residential Districts, and a small sign not to exceed six (6) square feet in the Agricultural District.
c) No public hearing by the Zoning Commission is required for approval of a home business.
and add the following:
4. Home Businesses are permitted in the A and R districts subject to the following supplemental conditions:
a) Home business applications compatible with the zone in which they are proposed may be considered on a case-by-case basis, and may be subject to such conditions as are necessary or desirable to assure the health, safety, and welfare of neighboring property owners and the general public.
b) Additional conditions may include, but need not be limited to:
1. hours of operation.
2. noise, light, and dust control provisions.
3. parking space requirements.
4. screening, either in the form of a vegetative buffer, or an opaque fence.
5. additional offset requirements from other neighboring land uses.
c) In no case shall there be advertising on the premises other than a small sign, not to exceed four (4) square feet in Residential Districts, or six (6) square feet in Agricultural Districts.

STATE OF IOWA DESIGNATION OF APPLICANT'S AUTHORIZED REPRESENTATIVE RESOLUTION
BE IT RESOLVED BY the Johnson County Board of Supervisors THAT Jim McGinley Johnson County Emergency Management Coordinator, is hereby authorized to execute on behalf of Johnson County Board of Supervisors, the hazard mitigation project and to file it with Iowa Emergency Management Division (IEMD) for the purpose of obtaining Federal/State financial assistance under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (a 93-288, as amended) and the Code of Iowa, Chapter 29C.

PART VII AUTHORIZATION
The undersigned does hereby submit this application for financial assistance in accordance with the Federal Emergency Management Agency's Hazard Mitigation Grant Program and the State of Iowa Hazard Mitigation Administrative Plan and certifies that the applicant (i.e., organization, city or county) will fulfill all requirements of the program as contained in the program guidelines.

RESOLUTION 12-17-98-03
LOCAL MATCH RESOLUTION FOR THE HAZARD MITIGATION GRANT PROGRAM
Whereas, Johnson County Board of Supervisors (subgrantee), County of Johnson, has made application through Iowa Emergency Management Division (EMD) to the Federal Emergency Management Agency (FEMA) for the Hazard Mitigation Grant Program, in the amount of $169,940 for the total project, or $42,485 as the 25% of local match, which would include $16,994 of anticipated State of Iowa 10% match, and
Whereas, Johnson County Board of Supervisors (subgrantee) recognized the fact that the Hazard Mitigation Grant Program is 75% federal/25% local matching grant, and
Whereas, Johnson County Board of Supervisors (subgrantee) shall form an agreement with Iowa EMD and FEMA as to the date that said 25% shall be available to match the federal funds awarded.
Johnson County Board of Supervisors (subgrantee) agrees to provide $42,485 (Forty-two thousand four hundred eighty five dollars) of local monies to be used as matching funds for the Hazard Mitigation Grant Program Project as outlined in the grant application.

AMENDING RULES AND REGULATIONS GOVERNING ONSITE WASTEWATER TREATMENT AND DISPOSAL SYSTEMS.
Whereas: The Johnson County Board of Health, in accordance with Chapter 137.2, Code of Iowa, 1997, shall have the power to make and enforce such reasonable rules and regulations not inconsistent with law or with the laws of the state board as may be necessary for the protection and improvement of public health: and
Whereas: The Johnson County Board of Health, has had Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems since June 9, 1965: and
Whereas: The Johnson County Board of Health, held a public hearing on October 19, 1998 to discuss amending the Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems, a copy of which is attached hereto: and
Whereas: The Johnson County Board of Health approved and recommended to the Johnson County Board of Supervisors the amendment of Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems on December 17, 1998:
Now, therefore, be it resolved: That in accordance with the provisions of Chapter 137.6 (2) (a) of the Code of Iowa, 1997, the Johnson County Board of Supervisors does hereby approve the amended Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems.

ESTABLISHING FEES FOR ONSITE WASTEWATER TREATMENT AND DISPOSAL SYSTEMS.
Whereas, The Johnson County Board of Health, in accordance with Chapter 137.7 (4), Code of Iowa, 1997, may issue licenses and permits and charge reasonable fees therefore in relation to the collection or disposal of solid waste and the construction or operation of private water supplies or sewage disposal facilities: and
Whereas: The Johnson County Board of Health, in accordance with Chapter 137.2, Code of Iowa, 1997, shall have the power to make and enforce such reasonable rules and regulations not inconsistent with law or with the laws of the state board as may be necessary for the protection and improvement of public health: and
Whereas: The Johnson County Board of Health approved and recommended to the Johnson County Board of Supervisors the amendment of Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems on December 17, 1998: and
Whereas: The Johnson County Board of Supervisors adopted the amended Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems on December 17, 1998: and
Whereas: Section 4.12 of the Johnson County Board of Health's Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems states that all fees shall be determined periodically by the Board of Supervisors:
Now, therefore, be it resolved: That in accordance with the provisions of Section 4.12 of the Johnson County Board of Health's Rules and Regulations Governing Onsite Wastewater Treatment and Disposal Systems, the fees are established as follows:
