MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
DECEMBER 31, 1998
Chairperson Bolkcom called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:08 a.m. Members present were: Joseph Bolkcom, Charles Duffy, Jonathan Jordahl, Stephen Lacina, and Sally Stutsman.
Unless otherwise noted, all actions were taken unanimously.
Motion by Lacina, second by Jordahl, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors.
Motion by Stutsman, second by Lacina, to approve the minutes of the formal meeting of December 17, 1998.
Motion by Duffy, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
Motion by Lacina, second by Stutsman, to accept the Recorder's Report of Fees Collected for the month of November, 1998, in the amount of $133,962.98, as submitted by County Recorder Deborah Conger.
Motion by Jordahl, second by Stutsman, to approve the Johnson County Land Use Plan with the friendly amendments. Roll call: aye: Jordahl, Stutsman, Bolkcom, Lacina; nay: Duffy.

Motion by Lacina, second by Stutsman, to approve the Johnson County Family Medical Leave Act (FMLA) and Flex Time Policy.
Application Z9850 of Timberwood Estates, signed by Larry Marak, Cedar Rapids, Iowa, requesting rezoning of 10.97 acres (2-lots) from A1 Rural to RS-5 Suburban Residential of certain property described as being in the East 1/4 of Section 18; Township 81 North; Range 7 West of the 5th P.M. in Johnson County, Iowa (This property is located on the west side of Seneca Road NW, approximately 1/4 of a mile east of its intersection with Blain Cemetery Road NW in Jefferson Twp.)
Motion by Lacina, second by Duffy, to waive the requirement of three considerations before amending an ordinance and to approve Application Z9850 on first and second consideration. Roll call: aye: Stutsman, Bolkcom, Lacina, Duffy; nay: Jordahl.

SETTING PUBLIC HEARING FOR CONDITIONAL USE PERMIT
Be It Resolved by the Johnson County Board of Supervisors in session held on December 31, 1998, as follows:
That a public hearing be set for the following application requesting approval of a Conditional Use Permit for a Home Business:
Application CU9808 of James P. and Katherine S. Andersen, signed by James P. Andersen requesting a Conditional Use Permit to operate a home business in the SW 1/4 of the SW 1/4 of Section 33: Township 80 North; Range 7 West of the 5th P.M. in Johnson County, Iowa. (This parcel is located on the north side of 340th Street SW, approximately 1/2 mile west of its intersection with Ireland Avenue in Clear Creek Twp.)
Now, therefore, be it resolved
That a public hearing be held on the 14th day of January, 1999 at 5:30 p.m. in the Board Room, Johnson County Administration Building, 913 South Dubuque Street, Iowa City, Iowa, on the above applications.
That the Johnson County Auditor be authorized to publish the official notice of the above public hearing.

Convened at 10:39 a.m. as a Public Hearing on Conditional Use Permit CU9807.
Application CU9807 of Lynelle Mellecker requesting approval of a Conditional Use Permit to operate a Home Business for pet grooming on property described as Lot 1 of Breezy Hill Subdivision, located in SW 1/4 of Section 6; Township 78 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This property is located at 4760 Maier Avenue SW, approximately 900' north of 480th Street SW on the east side of Maier Avenue SW in Liberty Twp.)
Lynelle Mellecker was present to answer questions.
RESOLUTION 12-31-98-Z2
APPROVING THE CONDITIONAL USE PERMIT FOR THE OPERATION OF A HOME BUSINESS
Whereas, the owner has filed application CU9807 for approval of a Conditional Use Permit to operate a pet grooming business as a Home Business, and
Whereas, the Johnson County Board of Supervisors have reviewed said application and finds the proposed use to be consistent with the requirements of Chapter 8:1.34 of the Johnson County Zoning Ordinance.
Now, Therefore, Be It Resolved By The Board Of Supervisors Of Johnson County, Iowa:
That said Conditional Use Permit be approved.
That the Chairperson be directed to sign said permit
Motion by Lacina, second by Jordahl, to approve Resolution 12-31-98-Z2.
Public Hearing closed at 10:45 a.m.
Motion by Jordahl, second by Duffy, to approve and authorize the Chairperson to sign the Settlement Stipulation in Oakes v. Johnson County.
Motion by Lacina, second by Jordahl, to approve the Health Center USA Grant Application and the request for Johnson County to submit the application on its behalf.
Motion by Stutsman, second by Lacina, to approve two additional slots in the ACE Program at a cost of approximately $22,000 for the balance of FY 1999.
Motion by Lacina, second by Jordahl, to approve the family farm tax credits for 1998 as recommended by the County Assessor.
Motion by Stutsman, second by Jordahl, to appoint Deborah Conger as Interim Director of the Mental Health/Developmental Disabilities Department as of January 4, 1999 for a term not to exceed 6 months.
Motion by Lacina, second by Duffy, to appoint Tom Hoff to the Conservation Board for a term ending December 31, 2003. Roll call: aye: Stutsman, Bolkcom, Lacina, Duffy; nay: Jordahl.
Motion by Lacina, second by Stutsman, to adopt the County's Plan Document for Deferred Compensation Plans.
Motion by Lacina, second by Jordahl, to deny the disciplinary grievance from the Johnson County Sheriff's Office.
Adjourned to informal meeting of December 29 and 31, 1998 at 12:25 p.m.
