MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:

JANUARY 7, 1999

Chairperson Jordahl called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:05 a.m. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, and Sally Stutsman.

Unless otherwise noted, all actions were taken unanimously.

Motion by Duffy, second by Stutsman, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors.

Motion by Stutsman, second by Lehman, to approve the minutes of the formal meetings of December 31, 1998, and January 4, 1999.

Motion by Duffy, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.

RESOLUTION 01-07-99-B1

NAMING DEPOSITORIES

Whereas, the Johnson County Board of Supervisors of Johnson County in Johnson County, Iowa approves the list of financial institutions to be depositories of the Johnson County funds in conformance with applicable provisions of Iowa Code Chapter 12C.2 Deposit of Public Funds, Approval-requirements; and

Whereas, First National Bank is now Mercantile and Magna Bank is now Union Planters which necessitates a revision for the depository name changes; and

Whereas, this resolution amends Resolution 09-24-98-01;

Therefore be it resolved that the following depositories be approved.

AN ORDINANCE AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY FROM A1 TO RS-5

SECTION I. PURPOSE. The purpose of this ordinance is to amend the Johnson County Zoning Ordinance by changing the classification of the real estate described in Section II hereof from A1 to RS-5.

SECTION II. CHANGE IN CLASSIFICATION. The zoning classification of the following described real estate located in Jefferson Township and comprised of approximately 10.97 acres to wit:

Commencing at the East 1/4 corner of Section 18, Township 81 North, Range 7 West of the 5th Principal Meridian, Johnson County, Iowa; thence S 00° 35' 47" W along the east line of Lot 4 of Timberwood Estates as recorded in book 1316 at page 301 in the office of the Johnson County Recorder, 490.13 feet to the Point of Beginning; thence S 00°35' 47" W, 390.43 feet; thence S 89° 42'53" W, 615.17 feet; thence N 33° 57' 14" E, 804.18 feet; thence S 33° 39' 28" E, 193.33 feet; thence S 29° 11' 19" E, 129.04 feet to said Point of Beginning, containing 5.49 acres

SECTION III. DISTRICT MAPS. The portion of the District Maps maintained in accordance with Article V, Section 2 of the Johnson County Zoning Ordinance as pertains to the real estate described in Section II of this ordinance is hereby repealed and amended to reflect the foregoing change in classification.

SECTION IV. REPEALER. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION V. SAVINGS CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.

SECTION VI. EFFECTIVE DATE. This ordinance shall become effective, after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.

On December 31, 1998, motion by Lacina, second by Duffy, to waive the requirement of three considerations before amending an ordinance and to approve Application Z9850 on first and second consideration. Roll call: aye: Stutsman, Bolkcom, Lacina, Duffy; nay: Jordahl.

Motion by Stutsman, second by Duffy, to approve Application Z9850 on final consideration and to approve Ordinance 01-07-99-Z1. Roll call: aye: Lehman, Stutsman, Duffy: nay; Jordahl.

RESOLUTION 01-07-99-01

FARM TO MARKET CONSTRUCTION PROJECTS

Be it resolved by the Board of Supervisors of Johnson County, Iowa, that Mike Gardner, the County Engineer of Johnson County, Iowa, be and is hereby designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications therefore in connection with all Farm to Market construction projects in this county.

Motion by Stutsman, second by Duffy, to approve Resolution 01-07-99-01.

RESOLUTION 01-07-99-02

AUTHORIZING THE IOWA DEPARTMENT OF TRANSPORTATION TO HOLD LETTINGS ON FARM TO MARKET PROJECTS

Whereas, rules and regulations of the Iowa Department of Transportation require authorization from local County Boards of Supervisors to hold Farm to Market project lettings;

Now therefore be it resolved that the Iowa Department of Transportation may hold lettings on projects financed from the Farm to Market Road Fund.

Motion by Stutsman, second by Duffy, to approve Resolution 01-07-99-02.

RESOLUTION 01-07-99-03

DEFINING CONDITIONS UNDER WHICH COUNTY ROADS MAY BE TEMPORARILY CLOSED

Whereas, Section 306.41, Code of Iowa (1997), provides for the closing of certain highways when necessary for maintenance, construction or natural disaster;

Therefore be it resolved

1. That all portions of roads in the 1999 Construction Program be closed when necessary during the construction processes;

2. That any roads having maintenance operations performed necessitating closure be closed when necessary;

3. That any portions of road incurring some type of natural disaster be closed when necessary; and

4. The actual dates of closure are to be determined by the County Engineer for each necessary closure.

Motion by Stutsman, second by Duffy, to approve Resolution 01-07-99-03.

Motion by Stutsman, second by Duffy, to approve the implementation of Johnson County Mental Health/Developmental Disabilities 5% provider rate increase to be used on employee wage increases, effective January 1, 1999.

Motion by Duffy, second by Stutsman, to appoint Jim Schintler to the Compensation Commission under Licensed Real Estate Brokers or Sales Persons for a term ending December 31, 1999.
