MINUTES OF THE FORMAL MEETING OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
FEBRUARY 4, 1999
Chairperson Jordahl called the Johnson County Board of Supervisors to order in the Johnson County Administration Building at 9:00 a.m. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, Sally Stutsman, and Carol Thompson.
Unless otherwise noted, all actions were taken unanimously.
Motion by Stutsman, second by Duffy, to approve the claims on the Auditor's Claim Register, as approved by a majority of the Supervisors.
Motion by Duffy, second by Stutsman, to approve the minutes of the formal meeting of January 28, 1999.
Motion by Duffy, second by Stutsman, to approve the payroll authorizations submitted by department heads, as approved by a majority of the Supervisors.
RESOLUTION 02-04-99-B1
NAMING DEPOSITORIES
Whereas, the Johnson County Board of Supervisors of Johnson County in Johnson County, Iowa approves the list of financial institutions to be depositories of the Johnson County funds in conformance with applicable provisions of Iowa Code Chapter 12C.2 Deposit of Public Funds, Approval-requirements; and
Whereas, the Treasurer has requested the addition of Dain Rauscher, Inc. in Iowa City with a maximum balance of $7,000,000; and
Whereas, this resolution amends Resolution 01-07-99-B1;

Motion by Stutsman, second by Lehman, to approve Resolution 02-04-99-B1.
Application CU9305 of Johnson County Agricultural Association, Iowa City, signed Gene Mohling, requesting a Conditional Use Permit for Camper Rallies on certain described property described as being in the N 1/2 of the SE 1/4 and the S 1/2 of the NE 1/4 of Section 28; Township 79 North; Range 6 West of the 5th P.M. in Johnson County, Iowa (This property is located on the west side of Oakcrest Hill Road SW, at the Johnson County Fairgrounds in West Lucas Twp.)
Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign a request for an annual conditional use permit for the Johnson County Agricultural Association as resubmitted by Gene Mohling for the Mennonite Relief Sale and Hawkeye Kennel Club Show.
Amendment to the Johnson County Zoning Ordinance Chapter 8:1.16 C, District Use Regulations, Adding a new paragraph 8:1.16C, as follows: 8:1.16C CH-F District Use Regulations Premises in the CH-F Commercial Highway Commercial Fairgrounds District shall be used for the following purposes only: Fairgrounds. Accessory Uses: Single Family dwelling for on-site management and their families. An amendment to the Johnson County Zoning Ordinance, Chapter 8:1.4, Definition of Terms, Adding the following definition: Fairgrounds. An area of land used for county fairs in accordance with Chapter 174 of the Iowa Code, exhibitions, and shows including, but not limited to: Agricultural related office buildings, Animal shows and judging, Carnivals, Circuses, Community meeting or recreational buildings and uses, Concerts, Food booths and stands, Games, Rides, Rodeos, Sales and Auctions, Storage, Theaters. Such county fairs, exhibitions, and shows do not include racetracks or motorized contests of speed. Amendment to the Johnson County Zoning Ordinance, Chapter 8:1.5, adding the following specific district CH-F Highway Commerical Fairgrounds.
ORDINANCE 02-04-99-Z1
AMENDING THE JOHNSON COUNTY ZONING ORDINANCE BY ENACTING ADDITIONAL PROVISIONS TO CHAPTER 8:1.4 DEFINITIONS OF TERMS, CHAPTER 8:1.5 DISTRICTS AND BOUNDARIES, AND CHAPTER 8:1.6 DISTRICT USE REGULATIONS AND BY REPEALING ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH
Section 1. Purpose. The purpose of this ordinance is to further the stated purpose of the zoning ordinance by amending Chapter 8:1.4 Definition of Terms, Chapter 8:1.5 District and Boundaries, and Chapter 8:1.6 District Use Regulations and by repealing ordinances and parts of ordinances conflict herewith.
Section II. Amendments.
Amendment. Chapter 8:1.16C, adding a new paragraph as follows: 8:1.16C CH-F District Use Regulations. Premises in the CH-F Commercial Highway Fairgrounds District shall be used for the following purposes only: Fairgrounds. Accessory Uses: Single Family dwelling for on-site management and their families.

Section III. Repealer. All other ordinances or part of ordinances in conflict with the provisions of this ordinance are repealed.
Section IV. Saving Clause. If any section, provision or part of this ordinance shall be adjudged invalid, illegal or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid, illegal or unconstitutional.
Section V. Effective Date. This ordinance shall become effective after its passage and approval, upon publication as part of the proceedings of the Board of Supervisors.
On January 28, 1999, motion by Duffy, second by Stutsman, to waive the requirement of three considerations before amending an ordinance and to approve the proposed Amendment to the Johnson County Zoning Ordinance, District Use Regulations, as amended, on first and second consideration. Motion by Stutsman, second by Thompson, to approve the proposed Amendment to the Johnson County Zoning Ordinance, District Use Regulations, on final consideration and to approve Ordinance 02-04-99-Z1. Roll call: aye: Lehman, Stutsman, Jordahl, Thompson, Duffy.
Motion by Stutsman, second by Lehman, to approve and authorize the Chairperson to sign the contract to remodel units 9 and 10 at Eastdale Mall.
RESOLUTION 02-04-99-01
ESTABLISHING SPEED LIMIT FOR NAPLES AVENUE
Whereas, the City of Iowa City has received a request for a speed limit change on Naples Avenue from Iowa Highway 1, south 1700 feet to the City limits; and
Whereas, the Johnson County Council of Governments has conducted an engineering and traffic investigation on this road, as required by Section 321.285, Iowa Code: and
Whereas, the City of Iowa City and Johnson County share jurisdiction of Naples Avenue from Highway 1 south 1700 feet to the City limits.
Now, therefore, be it resolved by the Board of Supervisors of Johnson County, Iowa that the following speed limit be authorized and the County Engineer be authorized to erect and maintain proper signing as required by the Iowa Manual on Uniform Traffic Control Devices:
Beginning at its intersection with Iowa Highway 1 and extending south 1700 feet to the corporate limit of the City of Iowa City the speed limit shall be 35 mph on Naples Avenue.

Motion by Stutsman, second by Thompson, to approve and authorize the Chairperson to sign a contract amendment with Neumann Monson PC Architects to cover the services of Bill Garnos, Criminal Justice Consultant with CSG Consultants, Overland Park, Kansas to study space needs at the Johnson County Jail for $12,136.
Motion by Stutsman, second by Thompson, to approve and authorize Chairperson to sign County Application to the State Division of Substance Abuse and Health Promotion for County Substance Abuse funding.
Motion by Stutsman, second by Lehman, to approve and authorize Chairperson to sign contract with Teletron Cost Management Services for phone services.
