MINUTES OF THE CANVASS OF THE JOHNSON COUNTY BOARD OF SUPERVISORS:
NOVEMBER 9, 1999
Chairperson Jordahl called to order the Johnson County Board of Supervisors at 9:05 a.m. to act as a canvass board to certify the results of the City Elections of November 2, 1999. Members present were: Charles Duffy, Jonathan Jordahl, Mike Lehman, and Sally Stutsman; absent: Carol Thompson.
Unless otherwise noted, all actions were taken with the following vote: aye: Lehman, Stutsman, Jordahl, Duffy; absent: Thompson.
County Auditor and Commissioner of Elections Tom Slockett explained the results for the offices of North Liberty City Council Member and Iowa City City Council Member At-large were very close and individuals had requested that the canvass incorporate recounting the votes. He said this is something that the Board of Supervisors, acting as the Board of Canvassers, has as an option. Slockett said he would recommend, because of the closeness of the two races, that they recount the Iowa City and North Liberty ballots to assure the voters that the totals are correct. Slockett suggested the Board of Supervisors vote within the canvass to conduct the recount of the ballots. The Board of Supervisors could then proceed with the canvass of the cities not being recounted, while the poll workers on the Absentee Ballot Counting Board would proceed with the recount. Slockett suggested the County Attorney craft a suggested motion for the Board to proceed with the canvass, as discussed. County Attorney J. Patrick White then offered a suggested motion.
Motion by Stutsman, second by Duffy, under the Board of Supervisors authority as the Board of Canvassers, under section 50.24 of the Code of Iowa, that the Board of Supervisors requests the Commissioner of Elections and the Absentee Ballot Counting Board unseal the ballot envelopes containing the ballots cast in Iowa City and North Liberty and re-feed those ballots into the electronic ballot readers, re-tabulating those and the total ballots per precinct be verified for the offices of Iowa City City Council At-large and the North Liberty City Council and reprinted for the permanent record. Upon completion of that process the Counting Board and the Commissioner will make a report to the Board of Supervisors to allow them to conclude the canvass, and then the ballots will be resealed in the appropriate envelopes.
The Absentee Ballot Counting Board proceeded in the Board Room to conduct the recount of all ballots from Iowa City and North Liberty precincts. County Attorney J. Patrick White said this is not a recount in the technical statutory sense. He said this is the Board of Supervisors’ canvass, and the re-tally or re-scanning is proposed to be under the authority of the Board of Supervisors in the course of the canvass, which means it needs the Board of Supervisors’ oversight. The Board of Supervisors stayed in formal session as the Canvassing Board during the entire recounting procedure. The Board of Supervisors reviewed individual precinct results. A tie for the office of Swisher Park Commissioner was broken by the drawing of lots.
Slockett reported that in the process of counting the votes for Iowa City Precinct 10, it was determined that the ballots in the sealed voted ballot envelope were 4 short. He suggested that the Board authorize opening the sealed tally list envelope where the poll workers record the write-in votes. Since there were 4 write-in votes, it seemed possible that the ballots containing write-in votes might have been mistakenly sealed there.
Motion by Stutsman, second by Duffy, to authorize the Auditor to look in the tally list envelope for Iowa City Precinct 10.
Lehman left at 10:00 a.m. and returned at 10:05 a.m.; Stutsman left at 10:25 and returned at 10:30 a.m.; and Duffy left at 10:35 a.m. and returned at 10:43 a.m.
The Board of Supervisors reviewed the printouts from the ballot readers for each precinct as they were produced. Slockett summarized that during the recount there was a change in the totals for Charles Major, decreasing the winning margin for Steven Kanner from 3 to 2 votes.

FOR THE OFFICE OF Coralville Mayor there were four hundred five (405) votes cast as follows: Jim Fausett received three hundred eighty-four (384) votes and Scattered votes were twenty-one (21).
We therefore declare Jim Fausett duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Coralville City Council Member (TWO to be elected) there were seven hundred fifty-nine (759) votes cast as follows: Jean Newlin Schnake received three hundred seventy (370) votes, John Weihe received three hundred seventy (370) votes and Scattered were nineteen (19) votes.
We therefore declare Jean Newlin Schnake and John Weihe duly elected to the office of Council Member, for the term of 4 years.
FOR THE OFFICE OF Hills Mayor there were sixty-three (63) votes cast as follows: Cathy Fitzmaurice recieved sixty-one (61) votes and Scattered were two (2) votes.
We therefore declare Cathy Fitzmaurice duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Hills City Council Member (THREE to be elected) there were one hundred ninety-two (192) votes cast as follows: Benjamin C. Cahalan received forty-seven (47) votes, Matt Gavin received thirty-seven (37) votes, Scott Hebl received sixty-four (64) votes, Dave Ollendick received forty (40) votes and Scattered were four (4) votes.
We therefore declare Benjamin C. Cahalan, Scott Hebl and Dave Ollendick duly elected to the office of Council Member, for the term of 4 years.
FOR THE OFFICE OF Iowa City Council Member District A there were seven thousand two hundred ninety-seven (7,297) votes cast as follows: Jerry Hansen received two thousand nine hundred eight (2,908) votes, Ross Wilburn received four thousand three hundred sixty-one (4,361) votes and Scattered were twenty-eight (28) votes.
We therefore declare Ross Wilburn duly elected to the office of Council Member District A, for the term of 4 years.
FOR THE OFFICE OF Iowa City Council Member District C (ONE to be elected) there were seven thousand six hundred five (7,605) votes cast as follows: Irvin Pfab received four thousand two hundred seventeen (4,217) votes, Dean Thornberry received three thousand three hundred seventy-four (3,374) votes and Scattered were fourteen (14) votes.
We therefore declare Irvin Pfab duly elected to the office of Council Member District C for the term of 4 years.
FOR THE OFFICE OF Iowa City Council Member At Large (TWO to be elected) there were thirteen thousand three hundred sixty-one (13,361) votes cast as follows: Tim Borchardt received one thousand nine hundred sixty-six (1,966) votes, Steven Kanner received three thousand five hundred sixty-four (3,564) votes, Charles A. Major received three thousand five hundred sixty-two (3,562) votes, Dee Vanderhoef received four thousand one hundred eighty-eight (4,188) votes and Scattered were eighty-one (81) votes.
We therefore declare Steven Kanner and Dee Vanderhoef duly elected to the office of Council Member At Large, for the term of 4 years.
FOR THE OFFICE OF Lone Tree Mayor there were seventy-two (72) votes cast as follows: Bill Crawford received fifty-one (51) votes, Robert Wisor received twenty (20) votes, and Scattered was one (1) vote.
We therefore declare Bill Crawford duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Lone Tree City Council Member (TWO to be elected) there were eighty-nine (89) votes cast as follows: Larry Dautremont received two (2) votes, R. D. Elliott received three (3) votes, Karen Forbes received two (2) votes, Wilbur Huff received two (2) votes, Gary Mullinix received twenty (20) votes, Rick Ogren received two (2) votes, Randy Shalla received eight (8) votes, David Smith received eleven (11) votes, Bob Wisor received two (2) votes, Vida Wollrab received five (5) votes, Randy Yakish received nineteen (19) votes and Scattered received thirteen (13) votes.
We therefore declare Gary Mullinix and Randy Yakish duly elected to the offices of Council Member, for the term of 4 years.
FOR THE OFFICE OF North Liberty City Council Member (THREE to be elected) there were one thousand four hundred twenty-four (1,424) votes cast as follows: Steve Anderson received two hundred forty-four (244) votes, Matthew J. Bahl received three hundred six (306) votes, Ron Bandy received two hundred fifty (250) votes, William E. Dorst received three hundred thirteen (313) votes, Terry R. Irwin received one hundred forty-eight (148) votes, Mark Robe recieved one hundred fifty-two (152) votes and Scattered was eleven (11) votes.
We therefore declare Matthew J. Bahl, Ron Bandy, and William E. Dorst duly elected to the offices of Council Member, for the term of 4 years.
FOR THE OFFICE OF Oxford Mayor there were one hundred five (105) votes cast as follows: Donald H. Saxton received seventy-two (72) votes, David Cook received thirty-one (31) votes and Scattered were two (2) votes.
We therefore declare Donald H. Saxton duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Oxford City Council Member (THREE to be elected) there were two hundred ninety-four (294) votes cast as follows: Mary Harney-Schropp received eighty-one (81) votes, Joan Kahler received eighty-four (84) votes, Edward Kasper received one hundred two (102) votes, Tim Hennis received fifteen (15) votes, Lisa Olson received five (5) votes and Scattered were seven (7) votes.
We therefore declare Mary Harney-Schropp, Joan Kahler, and Edward Kasper duly elected to the offices of Council Member, for the term of 4 years.
FOR THE OFFICE OF Shueyville Mayor there were fifty-one (51) votes cast as follows: Joseph L. Zalesky received fifty-one (51) votes and Scattered was zero (0) votes.
We therefore declare Joseph L. Zalesky duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Shueyville City Council Member (FIVE to be elected) there were two hundred forty (240) votes cast as follows: Thomas L. Carver received forty-nine (49) votes, Michael J. Felton received forty-seven (47) votes, Patrick M. Murphy received forty-eight (48) votes, Peter A. Phillips received forty-eight (48) votes, Becky Neuhaus received twenty-seven (27) votes, Mark Cross received thirteen (13) votes and Scattered received eight (8) votes.
We therefore declare Thomas L. Carver, Michael J. Felton, Patrick M. Murphy, Peter A. Phillips, and Becky Neuhaus duly elected to the offices of Council Member, for the term of 2 years.
FOR THE OFFICE OF Solon Mayor there were two hundred seventy (270) votes cast as follows: Steven J. Grover received one hundred fifty-nine (159) votes, Merlin Studt received one hundred one (101) votes and Scattered were ten (10) votes.
We therefore declare Steven J. Grover duly elected to the office of Mayor, for the term of 4 years.
FOR THE OFFICE OF Solon City Council Member (TWO to be elected) there were five hundred thirty-five (535) votes cast as follows: Susan Ballantyne received one hundred thirty-nine (139) votes, Tim Broghammer received one hundred eighteen (118) votes, Kendall Krob received thirty-seven (37) votes, Jerry L. McAtee, Sr. received sixty-eight (68) votes, Kevin Samek received one hundred twenty-three (123) votes, Beverly Worrell received forty-eight (48) votes and Scattered were two (2) votes.
We therefore declare Susan Ballantyne and Kevin Samek duly elected to the offices of Council Member, for the term of 4 years.
FOR THE OFFICE OF Swisher Mayor there were one hundred seventy-four (174) votes cast as follows: Scott Grabe received one hundred twenty-four (124) votes, Jack Hall received forty-six (46) votes, and Scattered were four (4) votes.
We therefore declare Scott Grabe duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Swisher City Council Member (FIVE to be elected) there were seven hundred thirty-four (734) votes cast as follows: Barb Hoss received one hundred twenty-seven (127) votes, Mark R. Meier, Sr. received seventy-one (71) votes, Paul A. Reed received one hundred forty-seven (147) votes, Ann Richmond received one hundred twenty-one (121) votes, Tina Richmond received one hundred twenty-nine (129) votes, Kathy Riggle received eighty-seven (87) votes, Virginia Svec received forty-three (43) votes and Scattered were nine (9) votes.
We therefore declare Barb Hoss, Paul A. Reed, Ann Richmond, Tina Richmond, and Kathy Riggle duly elected to the offices of Council Member, for the term of 2 years.
FOR THE OFFICE OF Swisher Park Commissioner there were twenty-five (25) votes cast as follows: Dave Chalupsky received three (3) votes, Erv Jones received three (3) votes, Don Lorenzen received two (2) votes, Tina Richmond received two (2) votes, Henry R. Ruprecht received two (2) votes, Larry Svec received two (2) votes, Steve Tomash received two (2) votes and Scattered were nine (9) votes.
We therefore declare Dave Chalupsky duly elected to the office of Park Commissioner, for the term of 6 years. Determined by lot according to Chapter 50.44 of the Code of Iowa, as amended.
FOR THE OFFICE OF Tiffin Mayor there were forty-seven (47) votes cast as follows: Glenn R. Potter received forty-five (45) votes and Scattered were two (2) votes.
We therefore declare Glenn R. Potter duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF Tiffin City Council Member (TWO to be elected) there were eighty-two (82) votes cast as follows: Karin A. Dils received forty (40) votes, Michael Gericke received twenty-three (23) votes, Danny L. John received seventeen (17) votes and Scattered were two (2) votes.
We therefore declare Karin A. Dils and Michael Gericke duly elected to the offices of Council Member, for the term of 4 years.
FOR THE OFFICE OF University Heights Mayor there were forty (40) votes cast as follows: Donald S. Swanson received thirty-seven (37) votes and Scattered were three (3) votes.
We therefore declare Donald S. Swanson duly elected to the office of Mayor, for the term of 2 years.
FOR THE OFFICE OF University Heights City Council Member (FIVE to be elected) there were one hundred eighty-one (181) votes cast as follows: Louise A. From received thirty-six (36) votes, William W. Gay received thirty-eight (38) votes, Gloria N. Jacobson received thirty-three (33) votes, Martin L. Jones received thirty-five (35) votes, Richard C. Martin received twenty-eight (28) votes and Scattered were eleven (11) votes.
We therefore declare Louise A. From, William W. Gay, Gloria N. Jacobson, Martin L. Jones and Richard Martin duly elected to the offices of Council Member, for the term of 2 years.
Motion by Stutsman, second by Lehman, to approve the results of the City Elections of November 2, 1999, incorporating the results of the recount of the Iowa City and North Liberty ballots.
