Code of Iowa sections relevant to filling a County Recorder vacancy

Following are the relevant Code of Iowa sections related to filling a vacancy for County Recorder, filling a potential vacancy for County Supervisor, filing for the 1998 Primary Election, and combining county offices.

Action by Board following resignation of Recorder:

The Board may make an appointment to fill the vacancy after the notice of intent to appoint is published or after the vacancy occurs, whichever is later. The appointment shall be made within 40 days after the vacancy occurs. A person appointed shall have actually resided in the county 60 days prior to appointment. The board may on its own motion or upon petition call for a special election to fill the vacancy, giving at least 30 days notice. Code of Iowa, Section 69.14A

Petition calling for special election to fill vacancy - Recorder's Office:

Petition presented to the county auditor's office within fourteen days after the appointment or publication of notice to appoint, whichever is later.

Petition must be signed by no less then 4,574 eligible electors (10 percent of votes cast for the office of president or governor from the last general election).

Code of Iowa, Section 69.14A and Section 331.306

Nomination by political party for name placement on special election ballot for Recorder:

For any office to be filled by the voters of an entire county by the party's county convention, which may be reconvened by the county party chairperson.

The name of a candidate so nominated shall be submitted in writing to the appropriate commissioner at the earliest practical time but not less than twenty days prior to the date set for the special election.

Nominations certified shall be accompanied by an affidavit executed by the nominee.

Code of Iowa Sections 43.78 and 43.88

Nomination by petition for name placement on special election ballot for Recorder:

Nominations made for a special election called pursuant to section 69.14A shall be filed by 5:00 p.m. no less than twenty days before the date of the election. Code of Iowa Section 44.4

Nomination by petition - signed by eligible electors of the county equal in number to at least 1 % of the number of registered voters in the county on July 1 in the year preceding in which the office will appear on the ballot, or by at least 250 eligible electors of the county, whichever is less. Code of Iowa Section 45.1(5)

Formation of a committee of county officers following resignation of a Supervisor:

A committee made up of the auditor, recorder and treasurer may make an appointment to fill the vacancy after the notice of intent to appoint is published or after the vacancy occurs, whichever is later. The appointment shall be made within 40 days after the vacancy occurs. A person appointed shall have actually resided in the county 60 days prior to appointment. The committee may on its own motion or upon petition call for a special election to fill the vacancy, giving at least 30 days notice. Code of Iowa, Section 69.14A and Section 69.8

June 2, 1998 Primary Election for county office:

Monday, March 2. First day for partisan candidates to file nomination papers to county auditor (92 days before the day of the election). Code of Iowa, Section 43.11

Wednesday, March 25, 5:00 p.m. Last day to file nomination papers (69 days before the day of the election). Code of Iowa, Section 43.11

Petition must be signed with a minimum of 100 signatures for the Republican and Democratic Party and 47 signatures for the Reform Party (2 percent of the vote cast for president or governor in the last general election or 100 signatures, whichever is less). Code of Iowa, Section 43.20(1)(d) and 43.20(2)

Petition calling for combining of county offices:

Petition presented to the county auditor's office no later than Wednesday, August 19, 1998 (no later than five working days before the filing deadline for candidates for county offices in the next general election).

Petition must be signed by no less than 8,505 eligible electors (25 percent of votes cast for the county office receiving the greatest number of votes from the previous general election).

The board shall direct the commissioner of elections to call an election for the purpose of voting on the proposal. General Election November 3, 1998.
